Elevate Media Platform, Inc. ("Elevate", "we", "us", or "our") operates EMP Studio at emp.studio (the "Platform"). This Privacy Policy explains how we collect, use, disclose, and protect information about users of our Platform, including creators, brands, agencies, distributors, and management organizations.

By accessing or using the Platform, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

2.1 Account Information

When you register for an account, we collect your name, email address, organization name, and role type (creator, brand, agency, distributor, or platform administrator).

2.2 Creator Profile Data

For creator accounts, we may collect or receive: social media handles and profile URLs, biographical information, content category and niche, follower counts and audience metrics, engagement rates, estimated earnings ranges, and brand deal history.

2.3 Connected Platform Data (OAuth Integrations)

When you connect a third-party platform account (such as YouTube, Instagram, TikTok, Twitch, Kick, LinkedIn, Twitter/X, Spotify, or Google Drive), we collect data made available through that platform's API, including:

  • Channel or profile identifiers and display information
  • Subscriber, follower, and view counts
  • Video and content performance metrics
  • Audience analytics and demographic summaries
  • OAuth access tokens and refresh tokens (stored encrypted)

2.4 Google API Data — Limited Use Disclosure

EMP Studio's use of information received from Google APIs (including YouTube Data API v3 and YouTube Analytics API) adheres to the Google API Services User Data Policy, including the Limited Use requirements. Specifically:

  • We only request YouTube API data that is necessary to provide the Platform's analytics and intelligence features.
  • We do not sell YouTube user data to third parties.
  • We do not use YouTube data for advertising purposes or for building user profiles for advertising.
  • We do not allow humans to read YouTube user data unless you have given explicit permission, it is necessary for security purposes, or it is required by law.
  • YouTube data is used solely to display your own channel analytics and performance metrics within the Platform.

You may revoke the Platform's access to your Google account at any time via your Google Account Permissions page or by disconnecting the integration within the Platform.

2.5 Usage and Technical Data

We automatically collect information about how you use the Platform, including pages visited, features used, timestamps, IP addresses, browser type, and device information. This data is used to improve Platform performance and security.

2.6 Uploaded Documents and Files

If you upload documents (financial data, presentations, or media files) to the Platform, we store these files securely in encrypted cloud storage. Uploaded documents may be processed by AI systems to extract structured data at your direction.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Platform and its features
  • Display analytics dashboards and intelligence reports for your connected accounts
  • Generate AI-powered insights, forecasts, and audience profiles at your request
  • Match creators with brands and agencies based on audience alignment
  • Send transactional emails (account invitations, password resets, connection notifications)
  • Detect, investigate, and prevent fraudulent or unauthorized activity
  • Comply with applicable legal obligations

We do not sell your personal information to third parties.

4. Information Sharing and Disclosure

4.1 Within the Platform

Creator analytics and profile data may be visible to administrators, managers, and authorized internal team members within the Platform. Creators can view their own data at all times.

4.2 Service Providers

We share data with trusted third-party service providers who assist us in operating the Platform, including:

  • Supabase — database hosting and authentication
  • Vercel — application hosting and edge infrastructure
  • Anthropic — AI language model processing (data is not retained by Anthropic for training)
  • Google (Gemini) — AI document and media processing
  • Resend — transactional email delivery
  • Apify — publicly available social media data collection

All service providers are contractually required to protect your data and use it only for the services they provide to us.

4.3 Legal Requirements

We may disclose information if required by law, regulation, court order, or governmental authority, or if we believe disclosure is necessary to protect the rights, property, or safety of Elevate, our users, or the public.

5. Data Retention

We retain your account data for as long as your account is active or as needed to provide Platform services. Connected platform tokens are stored in encrypted vault storage and are deleted when you disconnect a platform integration or close your account.

Analytics and metrics data (e.g., historical channel statistics) may be retained for up to 24 months to support trend analysis features. Uploaded documents are retained until you delete them or close your account.

You may request deletion of your account and associated data at any time by contacting us at the address below.

6. Data Security

We implement industry-standard security measures to protect your information, including:

  • Encryption of OAuth tokens using Supabase Vault (AES-256)
  • Encrypted storage for all uploaded files
  • HTTPS/TLS for all data in transit
  • Row-level security policies enforced at the database layer
  • Role-based access control limiting data access by user type

No method of transmission over the Internet is 100% secure. We cannot guarantee absolute security, but we are committed to maintaining appropriate safeguards.

7. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request that we correct inaccurate or incomplete data.
  • Deletion: Request that we delete your personal data, subject to legal obligations.
  • Portability: Request an export of your data in a machine-readable format.
  • Objection / Restriction: Object to or request restriction of certain processing activities.
  • Revoke OAuth Access: Disconnect any connected platform integration at any time from the Integrations page.

8. California Privacy Rights (CCPA)

If you are a California resident, you have the right to know what personal information we collect and how it is used, the right to delete personal information, and the right to opt out of the sale of personal information. 9. International Data Transfers

EMP Studio operates from the United States. If you are accessing the Platform from outside the United States, your data may be transferred to, stored in, and processed in the United States or other countries where our service providers operate. By using the Platform, you consent to such transfers.

10. Children's Privacy

The Platform is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us immediately.

11. Third-Party Links

The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you access through our Platform.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes by email or through a notice on the Platform. The "Last updated" date at the top of this page will always reflect when the policy was last revised. Continued use of the Platform after changes constitutes your acceptance of the updated policy.
